This Privacy Policy ("Policy") describes how Clux ("Clux," "we," "our," or "us") collects, uses, discloses, and safeguards information in connection with our mobile application, website, and related services (collectively, the "Services"). Please read this Policy carefully. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy.

If you do not agree with any provision of this Policy, you must discontinue use of the Services immediately.

You control whether this content is designated as private (visible only to you) or public (shared according to your selected sharing settings). You are solely responsible for the content you create and the visibility settings you choose.

We automatically collect certain technical information when you interact with the Services, including:
  • Log data (access times, pages viewed, app features used)
  • Device information (device type, operating system, unique device identifiers)
  • IP address and approximate geographic location derived therefrom

1.4 User-Submitted Content

To the extent you attach photos, files, links, or other media to events or calendars within the Services, we collect and store that content on your behalf. You retain ownership of such content, subject to the license described in our Terms of Service.

2. How We Use Your Information

We use the information we collect solely for the following legitimate purposes:

  • To create, maintain, and operate your account and provide you with access to the Services
  • To enable you to create, manage, share, and view private or public calendars and events
  • To improve the functionality, performance, reliability, and security of the Services
  • To send you transactional communications, such as account confirmation, security alerts, and policy update notices
  • To respond to your support inquiries or feedback
  • To comply with applicable legal obligations

We do not sell, rent, or trade your personal information to any third party for advertising, marketing, or commercial purposes.

If you designate a calendar or event as "public," that content may be visible to other registered users of the Services and, where applicable, to the general public. You are solely and exclusively responsible for any information you elect to make publicly accessible through the Services. We strongly encourage you to exercise caution before publishing personal, sensitive, or identifying information in any public calendar or event.

3.2 Service Providers

We may share necessary information with trusted third-party service providers who assist us in operating the Services, including cloud hosting providers, database services, analytics platforms, and customer support tools. All such providers are contractually required to maintain the confidentiality of your information and to use it solely for the purposes for which it was disclosed.

3.3 Legal and Compliance Disclosures

We may disclose your information if we reasonably believe such disclosure is required or permitted by law, regulation, legal process, or governmental authority; to protect the rights, property, or safety of Clux, our users, or the public; or to enforce our Terms of Service or other agreements.

You may request deletion of your account at any time through the account settings within the application. Following a verified deletion request, we will remove your personal data from our active systems within a commercially reasonable period, except where retention is required to comply with applicable law, resolve disputes, or enforce our agreements.

Certain aggregated or de-identified data, which cannot reasonably be used to identify you, may be retained indefinitely for analytics and service improvement purposes.

  • Any information you designate as "public" may be accessed, copied, or redistributed by other users or third parties, and Clux has no obligation or ability to control such downstream use
  • Clux is not responsible for, and expressly disclaims all liability arising from, any loss, harm, damage, dispute, or claim resulting from content shared by you or other users

We reserve the right, but assume no obligation, to review, moderate, or remove user-generated content that we determine, in our sole discretion, violates this Policy or our Terms of Service.

7. Children's Privacy

The Services are not directed to, and we do not knowingly collect personal information from, individuals under the age of thirteen (13). If we become aware that we have inadvertently collected personal information from a child under age 13, we will take prompt steps to delete such information from our records. 8. International Data Transfers

Clux is operated in the United States. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where data protection laws may differ from those in your jurisdiction. By using the Services, you consent to such transfer, storage, and processing. Where required by applicable law, we implement appropriate safeguards for cross-border data transfers.

9. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including:

10. Disclaimer of Warranties and Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Clux shall not be liable for:

  • The accuracy, completeness, timeliness, or reliability of any events, schedules, or information created or shared by users through the Services
  • Any loss, injury, claim, liability, or damage of any kind arising from your use of, or inability to use, the Services
  • Any unauthorized access to your account resulting from your failure to maintain the security of your account credentials
  • Any harm or damage resulting from content you or other users post, share, or make publicly available through the Services
  • Any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages

In no event shall Clux's total cumulative liability to you exceed the greater of (a) the amount paid by you for the Services in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so the above limitations may not apply to you in their entirety.

11. Third-Party Links and Services

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by Clux. This Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access. We are not responsible for the privacy practices, content, or data handling of any third-party services.

12. Changes to This Policy

We reserve the right to update or modify this Policy at any time. When we make material changes, we will post the revised Policy within the Services and update the "Effective Date" at the top of this document. In the event of significant changes, we may also notify you via the email address associated with your account.

Your continued use of the Services following the posting of any changes constitutes your acceptance of such changes. If you do not agree to the revised Policy, you must discontinue use of the Services.
